1. Introduction
Welcome to SunlitValleyPoint ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable to your use of our yacht charter services and the website at sunlitvalleypoint.sbs (the "Service"), which is provided by SunlitValleyPoint.
Your reservation of a charter or use of our Service indicates your acceptance of these Terms. If you do not agree with any section of these terms, you should not use the Service.
2. Service Overview
SunlitValleyPoint offers a variety of high-end yacht charter services, which include:
- Day-long yacht hires
- Evening sails
- Business getaways
- Exclusive celebrations
- Extended yacht charters
We offer our services based on their availability and the prevailing weather conditions. We have the right to change or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter booking, you are required to:
- Be a minimum of 18 years old
- Supply truthful and complete details
- Complete payment of the stipulated deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is subject to the receipt of your payment and our formal confirmation. We have the discretion to deny service to anyone.
3.3 Availability
Charter bookings are contingent on the availability of vessels and appropriate weather conditions. We will aim to accommodate your chosen dates and timings where possible.
4. Payment Terms
4.1 Pricing
The pricing for charters is provided in € and includes all applicable taxes unless stated otherwise. Prices may be changed without prior notice.
4.2 Payment Schedule
- A deposit of 50% of the entire cost of the charter is required at the time of booking
- The remaining balance is to be paid 48 hours prior to the departure of your charter
- Any additional expenses (if there are any): Payable at the end of the charter
4.3 Payment Methods
We accept payments using major credit cards, wire transfers, and certified bank drafts. Payment processing utilizes secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellations more than 72 hours prior to departure: Full refund less any processing fees
- Cancellations between 24 to 72 hours prior to departure: A 50% refund is available
- Cancellations less than 24 hours prior to departure: No refund available
5.2 Weather Cancellations
If the captain considers weather conditions to be unsafe, we will propose to:
- Reschedule your charter for an alternative date without extra charges
- Issue a full refund if it isn't possible to reschedule
5.3 Mechanical Issues
If there are any mechanical issues with the vessel you were assigned, we will make efforts to arrange a comparable alternative. Should this not be possible, you are entitled to a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions given by the crew
- Utilize safety gear as required
- Disclose any medical conditions that may impact their safety during the charter
- Stay within the designated areas of the vessel
6.2 Prohibited Items
The following objects are prohibited on board:
- Containers made of glass
- Illegal drugs
- Weapons of any kind
- Excessive quantities of beverages (beyond a reasonable personal amount)
- Animals (without prior consent)
6.3 Conduct
Passengers are expected to behave in a considerate and respectful manner. Charters can be discontinued without a refund if a passenger's behavior becomes a safety threat or interferes significantly with others' experience.
7. Liability and Insurance
7.1 Our Liability
Liabilities on our part are confined to the charter fee paid. We are not liable for:
- Injuries sustained due to a guest's carelessness
- Any loss or damages to personal belongings
- Indirect or punitive damages or any form of consequential loss
- Delays caused by adverse weather or unforeseen circumstances beyond our control
7.2 Insurance Coverage
We carry comprehensive maritime insurance that covers our fleet and maritime operations. Guests are responsible for their own travel and personal item insurance.
7.3 Assumption of Risk
Engaging in our yacht charter implies understanding and accepting that marine activities carry inherent risks. You are responsible for your personal safety and risks.
8. Modifications and Itinerary Changes
We maintain the right to adjust itineraries, travel routes, or timetables due to safety concerns, weather conditions, or operational needs. We will strive to provide suitable alternative experiences.
9. Force Majeure
Unforeseen circumstances beyond our control such as extreme weather, natural disasters, government regulations, port blockages, or mechanical breakdowns, release us from our obligation to fulfill contractual agreements like delays, cancellations, or alterations of services.
10. Privacy and Data Protection
We handle your personal information in adherence to our Privacy Policy. Using our services means you consent to the collection and use of your data as detailed in the Privacy Policy.
11. Intellectual Property
All the content on our website, including but not limited to text, illustrations, brand insignias, and images, is protected under copyright and intellectual property laws. Unauthorized reproduction, distribution, or the creation of derivative works is not permitted without explicit written authorization from us.
12. Governing Law
The legal framework for these Terms is based on the laws in force in Spain. Any disputes will be settled in the courts situated in Barcelona, Spain.
13. Changes to Terms
We reserve the authority to amend these Terms at any instance. Notification of such changes will appear on our website with the date of the latest revision. Your continued utilization of our services represents your agreement to the revised terms.
